By creating a Living Towers Florida Keys account, you also consent to receive electronic communications from Living Towers Florida Keys (e.g., via email or by posting notices to the Sites). These communications may include notices about your account (e.g., payment authorizations, password changes and other transactional information) and are part of your relationship with us. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including, but not limited to, that such communications be in writing. You should maintain copies of electronic communications from us by printing a paper copy or saving an electronic copy. We may also send you promotional communications via email, including, but not limited to, newsletters, special offers, surveys and other news and information we think will be of interest to you. You may opt out of receiving these promotional emails at any time by following the unsubscribe instructions provided therein.
4. Terms of Sale.
A. Purchases.
- PRODUCTS. We make certain seedlings, growing supplies or other products made available for purchase through the Services (collectively, the “Product(s)”).
- GIFTS. You may have the ability to purchase: (i) gift cards for other people through the Services (collectively, “Gifts”). Gifts are not refundable or redeemable for cash, unless required by applicable law. Gifts must be redeemed for purchases through the Services in accordance with our then-current procedures for redemption, which may require the recipient to create their own account and agree to these Terms in order to redeem the Gift.

We will collect applicable sales tax on Products shipped to the states for which we determine we have a duty to collect sales tax. If an item is subject to sales tax, you agree that the amount of taxes shown at checkout may be adjusted. Several factors may cause this, such as variances between processor programs and changes in tax rates.
E. Shipping and Handling.
You agree to pay any shipping and handling charges shown at the time you make a purchase. We reserve the right to increase, decrease, add, or eliminate shipping and handling charges from time to time. We will provide notice of the charges applicable to you before you complete your purchase.
Shipping is generally handled by a third-party courier (e.g., UPS, FedEx). Actual delivery dates may vary from those listed at checkout. You agree that you will not obtain, nor direct shipment of, a Product for export. All Products purchased from us are made pursuant to a shipment contract.
F. Deliveries
You are responsible for inspecting all Products you receive from us immediately upon delivery. Because seedlings are perishable, we offer a 48-hour guarantee against pest issues and significant damage.
If seedlings arrive damaged or unhealthy:

You must notify us at sales@livingtowers.com within 48 hours of delivery.

Include your order number and clear photos of the affected seedlings.

Do not discard seedlings until advised to do so.
Our Resolution Policy:

If 1–3 seedlings are damaged, we will issue a refund or credit.

If 4 or more seedlings are damaged, we will reship replacements at no cost.
Delivery instructions can be added through UPS My Choice or FedEx Delivery Manager. Couriers generally leave packages at the delivery address if no one is home. If you authorize an alternate receiver, they are bound by the same delivery terms.
We reserve the right to delay shipments due to extreme weather conditions (below 32°F or above 110°F). If you choose to ship under these conditions, you must acknowledge that no guarantee or refund will apply.
It is your responsibility to provide the correct shipping address. If the address is incorrect and the order has shipped, an $18 carrier address correction fee will apply. We are not responsible for orders delivered to the address provided at checkout.
We reserve the right to delay shipments due to extreme temperatures. If temps are below 32°F or above 110°F, seedlings may not survive the journey. If you choose to proceed with shipping under these conditions, you must acknowledge that no guarantee or refund will be provided.
Please double-check your shipping address before finalizing your order. If your address is incorrect and the order has not shipped, we may be able to update it at no cost. If the order has shipped but not yet delivered, an $18 address correction fee applies. We are not responsible for orders delivered to the wrong address provided at checkout.
G. Returns and Refunds (Standard Return/Refund Policy)
Due to the perishable nature of seedlings, we do not accept returns.
If you are not satisfied with your order, contact us within 48 hours of delivery at sales@livingtowers.com. Please provide your order number, photos of the affected seedlings, and a description of the issue. We will review your order and provide a resolution which may include:

Reshipment (if 4 or more seedlings are damaged)

Credit towards a future order

Partial or full refund
We cannot offer refunds or reshipments if:

You contact us after the 48-hour window

The damage occurs due to delays beyond 48 hours of delivery

The shipping address was incorrect or the order was not retrieved promptly
H. Damaged Products
Please do not discard seedlings until instructed to do so.

Courier-Related Damage: If your order arrives late, crushed, or otherwise mishandled in transit, notify us within 48 hours with photos and your order number. We will review your claim and determine whether a refund, credit, or reshipment applies.

Non-Courier Damage (e.g., pests, wilted plants): Report within 48 hours with photos. We will provide an appropriate resolution.
